What is the offence?
It is an offence in Queensland to start a vehicle, or drive a vehicle, in a way that makes unnecessary noise or smoke.
It is irrelevant whether the noise or smoke is made intentionally or not. This means that a person can be found guilty of making unnecessary noise or smoke if, for example, their vehicle was in a poor condition or if the vehicle was loaded in such a way that it made unnecessary noise or smoke.
Additionally, it is an offence to drive a vehicle with a noisy instrument attached or to ring a bell, sound a horn or play or use a noisy instrument, unless the device being used is a warning device.
What is the penalty?
The maximum penalty for this offence is a fine of up to $2,000.
