What is the application?
If your Queensland driver’s licence was disqualified for a period of more than 2 years after 13 March 2002, you may be eligible to apply to the court for the removal of your licence disqualification after the initial 2 year period has passed.
When considering whether to grant the application, the court will look at a number of factors including:-
- The character of the person disqualified;
- The person’s conduct subsequent to the order;
- The nature of the offence; and
- Any other circumstances of the case.
Frequently Asked Questions
Q: What if my application is unsuccessful?
A: If your application is unsuccessful, you will need to wait at least another year before you can apply again. It is therefore very important that you succeed on your first attempt and for this reason, we would recommend that you seek legal advice first.
Q: If my application is successful, when will I be able to start driving again?
A: Ordinarily you will be able to go straight from the court to the Department of Transport to apply for a licence. However the court has the power to make an order that you can only apply for your licence on some particular date in the future.
